Artwork, Copyright, Media &
Event Privacy Policy

Aloha, and mahalo for taking the time to understand how artwork, media, and privacy are handled at Maui Wedding Art.

This page explains the policy for artwork created by Ariel Quiroz / Maui Wedding Art, including live wedding paintings, live guest portraits, caricatures, commissioned artwork, time-lapse videos, behind-the-scenes media, and event-related promotional content.

This policy is separate from the website privacy policy, which explains how visitor information is handled when using this website.

TL;DR: Clients receive the original physical artwork after full payment, but Ariel Quiroz / Maui Wedding Art retains the copyright, reproduction rights, and media rights to the artwork, sketches, timelapses, process videos, and related event content unless otherwise agreed in writing. Ariel may photograph, film, and share the artwork and live art process for portfolio, website, social media, educational, and promotional use. Simple privacy requests, such as no names, tags, or identifying details, are usually included. Full privacy, NDA, or complete non-usage requests require a 20% Privacy and Non-Usage Fee based on the total service fee and do not transfer copyright ownership.

1. Artwork Ownership

When a client books Maui Wedding Art, the client is purchasing the original physical artwork or live art service described in the proposal, invoice, or agreement.

After full payment, the client receives ownership of the original physical artwork included in the booking. This may include a live wedding painting, guest portraits, caricatures, or commissioned artwork, depending on the service reserved.

Ownership of the physical artwork does not include transfer of copyright, reproduction rights, commercial use rights, or media rights unless agreed to separately in writing.

2. Copyright and Intellectual Property

All artwork created by Ariel Quiroz / Maui Wedding Art remains the intellectual property of the artist unless otherwise agreed in writing.

This includes:

  • Live wedding paintings

  • Guest portraits

  • Caricatures

  • Commissioned portraits

  • Sketches and studies

  • Artwork details

  • Time-lapse recordings

  • Process videos

  • Behind-the-scenes media

  • Photographs or videos created by Ariel or his team

  • Promotional media created from the live art experience

The client receives the original physical artwork, but copyright and reproduction rights remain with Ariel Quiroz / Maui Wedding Art.

3. Personal Use by Clients and Guests

Clients and guests may enjoy the original artwork for personal use.

This includes:

  • Displaying the artwork at home

  • Framing the artwork

  • Gifting the original physical artwork

  • Keeping guest portraits as personal keepsakes

  • Sharing personal photos of the artwork in a non-commercial way

Reproduction, commercial use, merchandise use, advertising use, resale of reproductions, or altered commercial use of the artwork requires written permission from Ariel Quiroz / Maui Wedding Art.

4. Live Painting Media, Timelapses, and Behind-the-Scenes Content

Live art is part of the experience. During weddings and events, Ariel Quiroz / Maui Wedding Art may photograph, film, or document the artwork and the live painting process.

This may include:

  • The painting in progress

  • The finished artwork

  • The easel setup

  • Timelapse videos

  • Behind-the-scenes footage

  • Short-form social media videos

  • Guest portrait setup and process

  • Caricature or portrait examples

  • Event atmosphere connected to the artwork

These images and videos may be used for portfolio, website, social media, publication, educational, editorial, advertising, and promotional purposes.

5. Portfolio and Promotional Use

Ariel Quiroz / Maui Wedding Art may use images or videos of the artwork, live art process, timelapses, and finished pieces to share examples of the work with future clients.

This helps couples, planners, venues, and guests understand the quality, style, and experience of live wedding painting, guest portraits, and event artwork.

Examples of promotional use may include:

  • Website galleries

  • Blog posts

  • Social media posts

  • Reels or short videos

  • Printed marketing materials

  • Educational content

  • Vendor or venue portfolio features

  • Advertising or promotional campaigns

Client names, guest names, and identifying personal details do not need to be shared for the artwork or process to be shown.

6. Simple Privacy Requests

Client privacy is respected.

Simple privacy requests are usually included at no additional cost. These may include:

  • No client names

  • No guest names

  • No tags

  • No exact event address

  • No sensitive family details

  • No posting before the couple shares publicly

  • Cropped images that focus mostly on the artwork

These requests should be shared in writing before the event so they can be honored clearly and thoughtfully.

7. Full Privacy, NDA, or Non-Usage Requests

If a client requests that Maui Wedding Art not share any artwork, guest portraits, event footage, timelapses, behind-the-scenes media, live painting process content, or finished artwork for portfolio or promotional use, a Privacy and Non-Usage Fee of 20% of the total service fee will apply.

This applies to requests such as:

  • Full event privacy

  • No portfolio use

  • No website use

  • No social media use

  • No timelapse sharing

  • No behind-the-scenes sharing

  • No guest portrait sharing

  • No finished artwork sharing

  • Signed NDA or non-disclosure agreement

  • No mention of the event, couple, planner, venue, guests, or artwork

The 20% Privacy and Non-Usage Fee compensates for the loss of portfolio, marketing, editorial, vendor, educational, and future promotional value connected to the artwork and live art experience.

Privacy restrictions must be requested and agreed to in writing before the event.

A privacy agreement, NDA, or non-usage request does not transfer copyright ownership. Copyright transfer requires a separate written agreement signed by Ariel Quiroz.

8. Guest Portrait Privacy

For live guest portraits, privacy requests may affect how the guest portrait station is photographed, filmed, or shared.

If full privacy is requested, Maui Wedding Art will not publicly share guest portraits, guest likenesses, guest interaction footage, timelapses, process videos, or event setup images connected to the service.

Because guest portrait examples are valuable for showing future clients how the experience works, full non-usage of guest portrait media is included under the 20% Privacy and Non-Usage Fee.

9. Client-Provided Media and Third-Party Vendors

If a wedding photographer, videographer, planner, venue, or guest captures Ariel painting or the artwork in progress, that media may be owned by the person or company who created it.

Maui Wedding Art does not automatically own third-party photo or video files unless permission is granted by the creator or client.

Likewise, clients and vendors may not use Ariel’s artwork, timelapse footage, or process media for commercial promotion, advertising, merchandise, or business marketing without written permission.

FAQ

Who owns the copyright to a live wedding painting or guest portrait?

Ariel Quiroz / Maui Wedding Art retains the copyright, reproduction rights, and intellectual property rights to all artwork created, unless a separate written copyright transfer is signed. The client receives the original physical artwork after full payment, but ownership of the physical artwork does not include copyright ownership.

Can I display the artwork at home?

Yes. Clients and guests may frame, display, keep, and enjoy the original physical artwork for personal use. Guest portraits, caricatures, and commissioned pieces are meant to be enjoyed as meaningful keepsakes.

Can I make prints or reproductions of the artwork?

Not without written permission. Reproduction, commercial printing, merchandise use, resale of copies, advertising use, or altered commercial use of the artwork requires written approval from Ariel Quiroz / Maui Wedding Art.

Can we share photos of the artwork on social media?

Yes, personal sharing is usually fine. Clients and guests may share personal photos of the artwork in a non-commercial way. Commercial use, vendor advertising, paid promotion, or business marketing use requires written permission.

Can Maui Wedding Art share photos or videos from our wedding or event?

Yes. Ariel Quiroz / Maui Wedding Art may photograph, film, and share the artwork, live painting process, time-lapses, behind-the-scenes moments, finished pieces, event setup, and related media for portfolio, website, social media, educational, editorial, advertising, and promotional purposes.

What if we do not want our names or faces shown?

Simple privacy requests are usually included at no additional cost. This may include no client names, no guest names, no tags, no exact private address, no sensitive details, or cropped images that focus mainly on the artwork. These requests should be shared in writing before the event.

What counts as a full privacy or non-usage request?

A full privacy or non-usage request means Maui Wedding Art may not publicly share any artwork, guest portraits, event footage, timelapses, process videos, behind-the-scenes media, finished artwork, or live painting content from the event. It may also include no mention of the couple, guests, planner, venue, event date, or artwork.

Is there an additional fee for full privacy, NDA, or non-usage?

Yes. Full privacy, NDA, or complete non-usage requests require a 20% Privacy and Non-Usage Fee based on the total service fee. This fee helps account for the loss of portfolio, marketing, vendor, educational, editorial, and future promotional value connected to the artwork and live art experience.

Does paying the 20% Privacy and Non-Usage Fee transfer copyright to us?

No. The privacy fee limits or prevents public sharing according to the written agreement, but it does not transfer copyright ownership. Copyright transfer requires a separate written agreement signed by Ariel Quiroz.

Can we approve images or videos before they are shared?

Yes, client review may be requested in writing before the event. Depending on the level of review and restrictions requested, this may be included as a simple privacy request or treated as a fuller non-usage/privacy arrangement.

How are guest portraits handled?

Guest portraits are treated as original artwork. Guests may keep and enjoy their physical portraits for personal use, while Ariel Quiroz / Maui Wedding Art retains the copyright and reproduction rights. If full guest privacy is requested, guest portraits, guest likenesses, guest interaction footage, timelapses, and setup images will not be publicly shared, and the 20% Privacy and Non-Usage Fee applies.

What about children or private family moments?

Privacy around children and sensitive family moments is handled with care. If there are specific guests, children, or moments that should not be shown, please share those requests in writing before the event so they can be respected clearly.

What if our photographer or videographer captures Ariel painting?

The photographer or videographer may own the copyright to the photo or video file they create. Maui Wedding Art does not automatically own third-party media unless permission is granted. However, Ariel Quiroz / Maui Wedding Art still retains copyright in the artwork shown within that media unless otherwise agreed in writing.

Can vendors, planners, or venues use photos of the artwork?

Vendor, planner, or venue use for commercial promotion, advertising, publication, or business marketing requires written permission from Ariel Quiroz / Maui Wedding Art, unless usage has already been clearly approved.

Can we request a custom NDA?

Yes. Custom NDA or privacy agreements may be reviewed before the event. If the NDA requires full non-usage or significant restrictions on portfolio, media, artwork, or promotional use, the 20% Privacy and Non-Usage Fee applies. Additional legal or administrative review may also apply for complex contracts.

When should privacy requests be made?

Privacy requests should be made in writing before the event, ideally before the final agreement or invoice is completed. This allows expectations to be clear for the couple, guests, planner, venue, and Maui Wedding Art team.
